Palestine Autonomous Areas: Failure to release prisoners despite High Court Decision

The International Secretariat of OMCT requests your URGENT intervention in the following situation in Palestine Autonomous Areas.

Brief description of the situation
The International Secretariat of OMCT has been informed by a reliable source of the failure to release detainees despite a High Court of Justice decision in Palestine.

According to the information received, a number of prisoners in Palestinian State Security Forces' prisons are still being held despite decisions issued by the High Court of Justice to release them.

The prisoners are:


1. Ameen Shafieq Diab – the Court decision to release him was issued 10 June 1999, and he is still being held in the Central Gaza Prison.

2. Abed El Nasser Karsoo’a – the Court decision to release him was issued 1 July 1999, and he is still being held in the Central Gaza prison.

3. Mohamed Musa Jadallah – the Court decision to release him was issued 6 July 1999, and he is still being held in the Central Gaza prison.

4. Abed El Raheem Jahjooh the Court decision to release him was issued 3 October 1999, and he is still being held in the Central Gaza prison.

5. Adel Aql Abed El Rhmaan- the court decision to release him was issued 6 October 1999, and he is still being held in the Central Gaza prison.

6. Fawzi Mohamed Abu El Qarah- the court decision to release him was issued 18 October 1999, and he is still being held in the Central Gaza prison.

7. Wa'el Talab Nassar- the court decision to release him was issued 8 November 1999, and he is still being held in the Central Gaza prison.

8. Khaleel Ahmad Abu U'da – the court decision to release him was issued 8 November 1999, and he is still being held in the Central Gaza prison.

9. Nasser Al Attar- The court decision to release him was issued 14 November 1999, and he is still being held in the Central Gaza prison.


The International Secretariat is gravely concerned by their arbitrary detention and, as such, the lack of respect for the High Court of Justice decisions.

Action requested
Please write to the authorities in Palestine urging them to:

i. take all necessary measures to guarantee the physical and psychological integrity of the above-mentioned persons and order their immediate release;

ii. guarantee adequate redress for their arbitrary detention;

iii. guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
