The International Secretariat of OMCT requests your URGENT intervention in the following situation in Israel.

Brief description of the situation

The International Secretariat of OMCT has been informed by Public Committee Against Torture in Israel (PCATI), a member of the OMCT network of arrest the and detention of a disabled man in Israel.

According to the information received, on 2nd July 2000, Mohammed Mustafa Mohammed Abed El Aziz, 23 years old, a resident of Beil Lahiya, was arrested at the Erez border crossing. He has since been detained in the GSS Interrogation Unit at the Shikma Detention Center. It is reported that Mr. El Aziz is physically disabled. He is incontinent, suffers from erosion of his left heel bone, a broken right ankle, birth defects and weakness in the nerves of his legs. He has difficulty walking and standing and is confined to a wheelchair.

From 3rd July 2000 until 7th July 2000 Mr. El Aziz was prohibited from meeting with counsel. On 9th July 2000 his attorney, Mustafa Yehie, was informed that an Order Prohibiting Meeting with Counsel was in effect until 10th July 2000. On 6th July 2000, Mr. El Aziz's detention was extended for a period of 21 days although he was not presented by counsel.

The International Secretariat of OMCT is gravely concerned for the physical and psychological integrity of Mr. El Aziz.

Action requested

Please write to the authorities in Israel urging them to:

i. take all necessary measures to guarantee the physical and psychological integrity of Mohammed Mustafa Mohammed Abed El Aziz; and order his immediate release in the absence of valid legal charges or, if such charges exist, bring him before an impartial and competent tribunal and guarantee their procedural rights at all times;
ii. guarantee the respect of human rights and the fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
