Libya: Exploitation of the Vulnerable – A Longstanding Human Trafficking Dilemma

Tunis, 30 July 2024 - On World Day Against Human Trafficking, the World Organisation Against Torture (OMCT) takes this opportunity to highlight the deepening crisis facing migrants, refugees and asylum seekers in Libya. A complex interplay of factors, including political instability, porous borders, and a weak rule of law, has transformed the country into a perilous hub for human trafficking and exploitation where trafficking networks operate with impunity, subjecting vulnerable populations to horrific abuses.

The European Union's approach to managing migration and pushback policies, while ostensibly aimed at stemming the flow of migrants, have substantially contributed to this crisis. By externalising border control and focusing on deterrence rather than protection, the EU and its member states have exacerbated the suffering of migrants, refugees, and asylum seekers. The absence of a robust international monitoring mechanism has also contributed to further deteriorate the situation.

To address this urgent situation, a comprehensive and coordinated response is imperative. Libyan authorities must prioritise the enactment of comprehensive legislative reforms to safeguard the rights of migrants, refugees and asylum seekers. These laws should establish clear standards for the treatment of migrants, mandate independent oversight mechanisms, and provide pathways for justice for survivors of abuse.

The European Union and its member states should revisit their policies towards migration management and make their cooperation with actors such as the Libyan Coast Guards contingent upon demonstrable improvements in the protection of migrants and by providing safe pathways for migration and refugee resettlement.
